Data protection and data security when using our websites and services are very important to us. WHO IS RESPONSIBLE?

For data where we determine the purposes and means of processing (e.g., website analytics, contact inquiries, client management for coaching services), we act as the Data Controller. PRINCIPLES OF DATA PROCESSING

The processing of Personal Data (e.g., collection, retrieval, use, storage, or transmission) always requires a legal basis.

c) Legal Basis

We process your Personal Data based on various legal grounds, including: i) your consent, ii) the necessity for the fulfillment of a contract or pre-contractual measures, iii) the necessity for the fulfillment of a legal obligation, or iv) the necessity to protect our legitimate interests, provided that your interests are not overridden.

d) Retention

Processed Personal Data will be deleted as soon as the purpose of the processing has been achieved and there are no longer any legally required retention obligations.

DATA WE COLLECT

a) Provision and Use of the Websites

When you visit and use our websites, we collect the Personal Data that your browser automatically transmits to our server. This is technically necessary for us to display our websites and to ensure their stability and security. In this sense, we collect the following data: i) IP address of the requesting computer, ii) Date and time of access, iii) name and URL of the file accessed, iv) website from which the access was made (referrer URL), v) browser used and, if applicable, the operating system of your computer as well as the name of your access provider. The legal basis is our legitimate interest.

b) Hosting and Marketing

The hosting, marketing, and other related services used by us for the purpose of operating our websites and managing our client interactions are provided by GoHighLevel, 525 Brannan St, San Francisco, CA 94107, United States. You can find their privacy policy at https://www.gohighlevel.com/privacy-policy. In doing so, GoHighLevel processes inventory data, contact data, content data, usage data, meta data and communication data of customers, interested parties and visitors of our websites and services, on the basis of our legitimate interests and our contractual agreement with them.

d) Cookie Consent

Our websites use a cookie consent tool to manage cookie preferences. When you interact with our websites, certain data related to your consent choices may be processed. The basis for processing is our legitimate interest and your consent.

e) Contacting Us (Contact Form)

When you use the contact form on our websites, we collect the data you submit, such as your name, email address, telephone number, and your message, in order to process your inquiry and respond to you. The legal basis is both your consent and pre-contractual measures. As a rule, we do not require any special categories of Personal Data for general inquiries.

OUR SERVICES (Workshops, Seminars, Keynote Speaking, 1-on-1 and Group Coaching)

When you engage with our services, such as registering for workshops or seminars, or participating in 1-on-1 or group coaching, we collect and process Personal Data necessary to provide these services. This may include:

Contact Information: Name, email address, phone number, and mailing address for registration and communication.

Service-Related Information: Information you provide during coaching sessions, workshops, or seminars that is relevant to the service being provided (e.g., business goals, sales challenges, leadership aspirations). This data is used solely for the purpose of delivering and improving our coaching and speaking services to you.

We act as the Data Controller for the Personal Data collected directly for the provision of our services. We ensure that access by our employees or contractors to your data is only available on a need-to-know basis, restricted to specific individuals, and is logged and audited. We communicate our privacy and security guidelines to our employees and enforce privacy and protection safeguards strictly. The legal basis for this processing is primarily the fulfillment of our contract with you.

SOCIAL MEDIA

We are present on social media platforms on the basis of our legitimate interest. If you contact or connect with us via social media, we and the respective platform may be jointly responsible for the processing of your data. The Personal Data collected when contacting us is to handle your request, and the bases are both your consent and our legitimate interest.

When you visit our social media profile, we, as the operator of the profile, process your actions and interactions with our profile (e.g., the content of your messages, inquiries, posts or comments that you send to us or leave on our profile or when you like or share our posts) as well as your publicly viewable profile data (e.g., your name and profile picture). Which Personal Data from your profile is publicly viewable depends on your profile settings, which you can adjust yourself in the settings of your social media account. The legal basis is our legitimate interest and your consent.

DATA SECURITY

We undertake to protect your privacy and to treat your Personal Data confidentially. In order to prevent manipulation, loss, or misuse of your data stored with us, we take extensive technical and organizational security precautions which are regularly reviewed and adapted to technological progress. These include, among other things, the use of recognized encryption procedures (SSL or TLS).

However, we would like to point out that, due to the nature of the Internet, it is possible that the rules of data protection and the above-mentioned security measures are not observed by other persons or institutions that are not in our area of responsibility. We have no technical influence on this. It is the user's responsibility to protect the data he or she provides against misuse by encrypting it or in any other way.

We may share your Personal Data with our business partners and within Testament Leaders Coaching for the purposes described in this Privacy Policy, including (but not limited to) conducting the services you request, or customizing our business to better meet your needs. We may also disclose your Personal Data for any purpose with your consent or for law enforcement, fraud prevention or other legal actions as required by law or regulation, or if we reasonably believe that we must protect us, our customers or other business interests. Except as described above of which you will be informed in advance, we will not disclose your Personal Data.

WHAT WE DO NOT DO

We do not request Personal Data from minors and children;

We do not use Automated decision-making including profiling; and

We do not sell your Personal Data.

PRIVACY RIGHTS

Your privacy rights are important to us. Depending on your state of residence, you may have specific rights regarding your Personal Data, including:

      Right to Know: The right to request information about the categories and specific pieces of Personal Data we have collected about you.

      Right to Delete: The right to request the deletion of Personal Data that we have collected from you, subject to certain exceptions.

ACCESS REQUEST

In the event that you wish to make a Data Subject Access Request, you may inform us in writing of the same. We will respond to requests regarding access and correction as soon as reasonably possible. Should we not be able to respond to your request within thirty (30) days, we will tell you why and when we will be able to respond to your request. If we are unable to provide you with any Personal Data or to make a correction requested by you, we will tell you why.

COMPLAINT TO A SUPERVISORY AUTHORITY

You have the right to lodge a complaint about our data processing with a data protection supervisory authority (e.g., your state's Attorney General's office or the Federal Trade Commission). However, we encourage you to contact us first so we can address your concerns.

OTHER USA SPECIFIC PROVISIONS

The following applies to users located eslewhere in the United States. While we understand and appreciate that privacy and consumer data protection laws differ as they are subject to each state's legislature, we are committed to following and applying the relevant privacy rules and regulations for your state.

COPPA (Children's Online Privacy Protection Act)

We do not specifically market to children under 13. Where children's data is processed for specific services, explicit parental consent is obtained, putting parents in control as mandated by COPPA.

CAN-SPAM Act

For commercial emails, we comply with CAN-SPAM. You can unsubscribe from future emails at any time by contacting us, and we will promptly remove you from our mailing lists.

Do-Not-Track (DNT)

Our website does not currently respond to DNT signals, as a uniform standard is not yet finalized. We will update this policy if a standard we must follow is adopted.

CANADA AND MEXICO SPECIFIC PROVISIONS

For users in Canada and Mexico, we apply the same rights and privileges as set out in this policy, acknowledging the similarities of their respective data protection laws (PIPEDA in Canada and LFPDPPP in Mexico) to the GDPR. In case of ambiguity, the most stringent provision will be chosen.

Right to complain: The Office of the Privacy Commissioner (www.priv.gc.ca) is Canada's national supervisory authority. In Mexico, the National Institute of Transparency, Access to Information and Personal Data Protection (INAI) (www.ifai.org.mx) is the national supervisory authority.
